1. Scope of Application

1.1 These General Terms and Conditions ("GTC") apply to all contracts between the provider of floorplanning.app and the users of the platform.

1.2 The platform is aimed at both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).

1.3 Deviating conditions of the user do not apply, unless their validity has been expressly agreed to in writing.

3. Subject matter of the contract

3.1 floorplanning.app is a web-based software solution for digital planning, visualisation and support in the installation of floors.

3.2 The software serves exclusively as a supporting tool for planning and visualisation. The results, suggestions, calculations and representations generated by the software do not constitute technical, manual, static, architectural or professional advice.

3.3 The user is obliged to independently check all results for completeness, plausibility, dimensional accuracy and suitability for the respective purpose before actually implementing them.

3.4 The use of the software does not replace a professional examination by qualified tradesmen, floor installers or other specialists.

Registration and user account

4.1 The use of the platform requires the registration of a user account.

4.2 The user is obliged to provide truthful information when registering.

4.3 Access data must be kept secret and may not be passed on to third parties.

4.4 The provider is entitled to temporarily block or permanently delete user accounts in the event of violations of these terms and conditions or in the event of improper use.

5. Conclusion of contract

5.1 The presentation of the services on the website does not constitute a legally binding offer.

5.2 The contract is concluded as soon as the user completes the ordering process and the payment has been successfully processed.

5.3 Payment is processed via Stripe. Stripe's Terms of Use and Privacy Policy also apply.

6. Subscription, term and termination

6.1 The software is used as part of paid subscriptions.

6.2 Monthly and annual subscriptions are offered.

6.3 The subscription is automatically renewed for the originally selected term, unless it is terminated before expiry.

6.4 The termination can be made at any time via the user account or via the functions provided by Stripe.

6.5 Termination shall take effect at the end of the current billing period.

6.6 In principle, fees already paid will not be reimbursed on a pro rata basis unless there are legal provisions to the contrary.

6.7 In addition, a temporary project pass can be offered. The Project Pass is not a subscription, ends automatically, and does not renew automatically.

6.8 The project pass is offered to new customers once per user account or organisation. It can be used for any number of projects during its lifetime, for example for several floors, rooms or variants.

6.9 Any terms already acquired and any renewals effectively acquired prior to an offer change shall remain valid until the stated expiry date with the range of functions promised at the time of purchase.

7. Fees and payment modalities

5.1. The prices at the time of order are valid.

7.2 Due to the application of the small business regulation according to § 19 UStG, no value added tax is calculated or shown.

7.3 If the user is in arrears with payments, the provider is entitled to temporarily restrict access to the platform until full payment has been made.

Platform availability

8.1 The provider shall endeavour to ensure that the platform can be used as uninterrupted as possible.

8.2 Temporary restrictions may arise in particular due to maintenance work, technical malfunctions, security updates or events beyond the Provider's control.

8.3 There is no entitlement to availability at any time or completely free of errors.

9. Licenses

9.1 The user receives a simple, non-exclusive, non-transferable right to use the software for the duration of the existing subscription.

9.2 The user is not entitled to copy, resell, rent, make publicly available or technically modify the software or parts thereof, unless this is expressly permitted by law.

10 User Obligations

10.1 The user is obliged to enter all entered dimensions, room data and other information carefully and correctly.

10.2 The user may not misuse the platform or circumvent technical protective measures.

10.3 The user is solely responsible for the actual implementation of the generated plans.

10.4 When importing DXF files, the user assures that he has the necessary rights to use, edit and transfer the drawings and plans contained. Rights of third parties, in particular copyrights, trade secrets and confidentiality rights, may not be violated.

10.5 Imported geometries, units and dimensions must be independently checked on the basis of the original documents before ordering, execution or transfer.

11. Liability

11.1 The use of the software is at the user's own risk.

11.2 The plans, calculations, material proposals and visualisations generated by floorplanning.app are for support purposes only and do not replace a technical examination.

11.3 In particular, the provider does not guarantee that the results generated are completely error-free, that material quantities are calculated exactly, that laying plans can be implemented correctly technically or professionally, or that the software is suitable for a specific purpose.

11.4 The user remains obliged to independently check all results before implementation.

11.5 The provider is liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, limb or health.

11.6 In the event of simple negligence, the provider is only liable in the event of a breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable damage typical of the contract.

11.7 Any further liability of the provider is excluded to the extent permitted by law.

11.8 The above limitations of liability also apply in favour of the legal representatives and vicarious agents of the provider.

§ 12 Right of cancellation for consumers

12.1 Consumers are generally entitled to a statutory right of withdrawal.

12.2 The user expressly agrees that the provider begins to perform the digital service before the expiry of the revocation period.

12.3 The user is aware that this consent may void the right of withdrawal in the event of complete fulfilment of the contract.

13. Data protection

Informationen zur Verarbeitung personenbezogener Daten befinden sich in der Privacy policy auf der Website.

Amendments to the GTC

14.1 The provider reserves the right to change these terms and conditions with effect for the future, provided that there is an objective reason for this.

14.2 Users will be informed of changes in good time.

15. Final provisions

15.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

15.2 This choice of law only applies to consumers insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has his habitual residence.

Should individual provisions of these terms and conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
